Antenuptial agreements are not just for the “rich and famous.” An antenuptial agreement is often appropriate and useful in a wide range of economic and social circumstances. Oftentimes, antenuptial agreements are useful tools in the event of a second or subsequent marriage, when either or both parties have children from prior relationships and want to protect distributions or inheritances to their children, in the event of death or divorce.
Postnuptial Agreements Postnuptial agreements are similar in purpose to an antenuptial agreement, but are entered into by spouses who are already legally married. A postnuptial contract is valid and enforceable only if at the time of its execution, each spouse is represented by separate legal counsel.
Cohabitation agreements are used for the same purpose, by persons who either do not intend to or cannot legally get married.
